OpenAI lawyers question Meta’s role in Elon Musk’s $97B takeover bid 

OpenAI is pressing Meta to hand over records concerning any coordination with Elon Musk and xAI about acquiring or investing in the ChatGPT-maker, according to a new court filing.

The request was disclosed Thursday in documents tied to Musk’s ongoing lawsuit against OpenAI. The company’s attorneys said Meta was subpoenaed in June for material relating to Musk’s unsolicited $97 billion offer to buy OpenAI earlier this year, an offer that was ultimately turned down. It is unclear if the requested documents exist.

The filing is part of Musk’s broader suit against OpenAI over its decision to transform its for-profit arm into a public benefit corporation, a step the company says is required to attract investors and move toward a public listing. Musk argues the change undermines the company’s original mission.

Meta has pushed back, asking the court to deny the subpoena. Its lawyers argue that Musk and xAI already possess any relevant information and that Meta’s private discussions about OpenAI’s restructuring are outside the scope of the case.
